TRAINING SERVICES

In order to assist clients in honing their negotiation and alternative dispute resolution (ADR) skills, JP&A has developed workshops on negotiation and ADR methods for in-house and outside counsel, as well as business managers and executives. These workshops cover a range of topics such as: determining whether a dispute is appropriate for ADR and which ADR method is suitable for a particular case; inviting an opponent to engage in ADR without suffering a tactical disadvantage; dealing with the “hard bargainer”; and addressing the interplay of ADR with discovery, confidentiality, and enforceability issues. In addition, the workshops: 

  • Focus on the principled negotiation methods developed by the Harvard Negotiation Project;  
  • Utilize experiential learning techniques; and
  • Provide customized materials developed by JP&A.

JP&A also provides seminars on an annual basis that serve to reinforce the information learned in the workshops and apprise clients of recent developments in the ADR field.
